1. Acceptance of Terms

By accessing or using Roasted ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Email communications & consent: Every email collection point — waitlist signup, account creation, and Pro interest notification — presents an explicit consent checkbox for marketing emails. Checking the box is optional; you can use the Service without opting in.

What we send: Marketing emails include launch notifications, product updates, feature announcements, and educational content about website optimization. Transactional emails (account confirmation, password reset, subscription receipts) are sent to all registered users regardless of marketing consent, as they are necessary to operate the Service.

How to opt out: You may withdraw marketing consent at any time via the unsubscribe link in any email or by contacting us at hello@getroastedby.ai. Unsubscribe requests are processed immediately and logged to our consent audit trail.

2. Description of Service

Roasted is an AI-powered website analysis tool. You submit a publicly accessible URL, and our system analyzes the site's design, copy, SEO, performance, trust signals, security, and conversion elements using automated AI agents. The results are provided for informational and educational purposes.

3. Website Scraping and Analysis

When you submit a URL, you authorize Roasted to access and analyze the publicly accessible content at that URL. You represent that:

You have the right to submit the URL for analysis
The URL points to publicly accessible content
You will not submit URLs to content you do not have permission to analyze
You will not use the Service to analyze sites in violation of those sites' terms

We only access publicly available web content. We do not attempt to access protected areas, bypass authentication, or access any content not freely available to the public.

4. Data Collection at Email Capture Points

The Service collects email addresses at three points: the waitlist form, account signup, and the Pro early-bird notification form. At each point we record:

Your email address
Whether you opted in to marketing emails (explicit checkbox)
The form or flow where consent was captured (e.g., "waitlist_form", "signup_form", "pricing_page")
A timestamp of the consent event
Cookie banner choices for analytics opt-in or essential-only mode
Your IP address at the time of submission (for compliance audit)

This data is stored in Supabase (our database provider) and serves as the authoritative record for whether we may send you marketing email. We do not use any third-party newsletter platform as the source of truth for consent — all consent state is managed in our own database. Analytics tracking stays off unless you explicitly accept it in the cookie banner.

5. User Accounts and Subscriptions

Some features require a paid subscription. Subscription fees are charged in advance on a monthly or annual basis. All sales are final unless otherwise stated. We reserve the right to change pricing with 30 days notice to existing subscribers.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse engineer, copy, or replicate the Service
Use automated scripts to bulk-submit URLs without authorization
Resell or redistribute analysis results without permission
Submit URLs containing illegal content

7. Domain Verification & Claiming

Users may claim ownership of domains through DNS TXT record or HTML meta tag verification. Claiming a domain grants the following:

Access to all public roast results for that domain
Email alert notifications when new roasts are submitted for that domain

Free accounts may claim one domain. Plus subscribers may claim unlimited domains. Claims can be released at any time via account settings. Roasted reserves the right to revoke claims if domain verification lapses for more than 30 days. Claiming a domain does not grant any right to modify, remove, hide, or suppress public roasts of that domain. Analyzed websites may trigger notifications to verified domain owners. Roast submissions are anonymous — submitter identity is never disclosed to domain owners.

8. Competitor Analysis

The comparison feature analyzes publicly available website content for the purpose of competitive benchmarking. Users represent that they are using comparison features for legitimate purposes such as competitive analysis, benchmarking, or self-improvement. Comparison results are informational and do not constitute professional competitive intelligence, legal, or business strategy advice.

9. Intellectual Property

All content, branding, and technology on Roasted is owned by Spiral App Labs. Analysis results generated by our AI are provided to you for personal and commercial use. We retain no ownership of analysis results once delivered to you.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE ANALYSIS RESULTS WILL BE ACCURATE OR COMPLETE. AI-GENERATED ANALYSIS IS FOR INFORMATIONAL PURPOSES AND SHOULD NOT BE TREATED AS PROFESSIONAL LEGAL, TECHNICAL, OR BUSINESS ADVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPIRAL APP LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. DMCA and Content Removal

If you believe any content on Roasted infringes your copyright, please contact us at legal@getroastedby.ai with a description of the content and your claim. We will respond promptly to valid DMCA takedown notices.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify registered users of material changes via email.

14. Governing Law

These Terms are governed by the laws of the State of Illinois, United States. Any disputes shall be resolved in the courts of Illinois.
